Hours: Mon - Fri, 9:00am - 5:00pm (37.5 hours pw)

The successful candidate must hold a full current driving licence (valid in the UK) and have access to a car prior to commencing employment or have *access to a form of transport which will permit yourself to carry out the duties of the post in full.

Overview

As Solicitor Consultant, you will assist in the provision of legal services to a range of clients within the Health and Social Care Sector. You will provide timely specialist legal advice, assistance and representation for clients in contracting and procurement of goods and services, including IT projects.

You will also provide these services in accordance with the standards established by the Chief Legal Adviser and the Organisation's Service Level Agreements with its clients.

Please note: You may be required by the Chief Legal Adviser to undertake duties in other areas of law in order to assist the efficient delivery of the service to clients

Responsibilities

Draft appropriate contracts and related documents in line with the instructions of clients taking account of the client's requirements and seeking to minimise risk. Review draft contracts and related documents and provide advice to clients whether oral or in writing including in relation to legal and other risks arising for the client, for patients and service users and to the public purse. Advise in relation to appropriate amendments to draft contracts and related documents and negotiate contractual terms where required.

Draft and provide legal advice on appropriate lawful procedures and methodologies for the procurement of goods and services, including for software and other IT related goods and services. This includes the drafting and review of relevant suites of procurement and related documents and providing legal advice and support to clients throughout the procurement process, as required.

Provide legal advice in relation to all legal issues relevant to the procurement and contracting for goods and services by the HSC sector, including matters such as the sharing of personal data and processing of personal data by contractors, requests for information under the Freedom of Information legislation and relevant regulatory issues.

Provide legal advice in relation to the proactive management of contracts in line with relevant Department of Health and another applicable public sector guidance in Northern Ireland. Provide legal advice in relation to all matters connected with the delivery of goods and services pursuant to contracts, including any contractual or other remedies open to clients.

Investigate and assess clients' legal liability in respect of contractual and/or procurement disputes and claims, to include reviewing relevant contractual and procurement documents, instructing appropriate experts and counsel and use of professional judgment by the job holder. Provide accurate and timely estimates to clients of potential legal liability and make recommendations to clients regarding practical and cost-effective solutions which they may choose to follow, often in very high value (multi-million pound), complex claims involving issues of considerable sensitivity and public interest.

Drafting pleadings and other court documentation as required, researching the law, and either appearing personally to present evidence and legal arguments to the Court, or instructing Counsel to do so, all to ensure that the interests of clients and public funds are adequately protected.

To provide training for HSC clients as required on relevant legal issues, provide written updates to clients on relevant legal developments as required and advise in relation to development of policy and practice relevant to procurement and contracting for goods and services, including IT projects within the HSC sector.

Other duties may also include a mix of the following: -

* Provide specialist advice in situations of high clinical and commercial sensitivity and urgency including advice concerning end of life decisions, interdicts and judicial review.

* Ensure that a high quality of legal service is delivered by clients by planning and organising the schedule of his/her own work in accordance with the operational requirements of their own and their Teams' allocated client base in co-operation with the Chief Legal Adviser, and other Team members and with colleagues in relation to general or specialist group work, using his/her initiative, professional skills and organisational acumen.

* Will, as required, complete enough training and self-development to meet the requirements laid down by the Law Society in terms of Continuous Professional Development.

* As an Officer of the Court will have a direct individual professional obligation to the courts. The job holder also has direct individual professional responsibility and accountability to the Law Society.

* Work in close association with Solicitors and support staff within DLS, sharing information and experience and participating in the development of the various sections to enable the Directorate to enhance its expertise and meet present and future demands and expectations of clients in the most efficient and effective way.

* Participate in lectures, seminars and at Conferences organised by DLS and other bodies speaking to groups of HSC staff in order to develop the knowledge and level of training of HSC, Board, Trusts and Agencies in relation to legal topics relevant to HSC in Northern Ireland.

* Provide clients on a regular basis and as requested with accurate legal risk rating assessments in respect of their claims portfolios and estimates of projected settlement and expense values to support clients in the preparation of their annual financial performance budgets.

Required Skills

1. Extensive experience in Commercial Law

2. Extensive experience in Contracts including GDPR data access agreements, procurement and IT contracts

3. Experience working as a Solicitor with eligibility to practise in Northern Ireland at the time of application

4. Demonstrate experience in providing Legal advice and/or representation in the areas of commercial (including contracts) and/or procurement law.

5. Demonstrate at least 5 years post qualification experience, within the last 7 years
