Legal Counsel/Lawyer - Wealth and Investments

About Wealth UK Legal

The Wealth UK Legal team provides legal advice and support to each of the businesses that make up Wealth & Investments, Private Bank & Overseas Services (referred to here collectively as "Wealth"). The Wealth businesses are largely retail-facing, but offer a very large spectrum of products and services ranging from unsecured loans, investment leverage loans and products designed for business banking and overseas customers through to discretionary portfolio management, investment advice, structured products and derivatives.

Role Purpose

The purpose of the role is to work with existing members of the Wealth Legal Services team, and with internal clients of the Wealth Legal Services team, to provide support and expert legal advice on Barclays Wealth's day-to-day legal issues. The successful candidate will need the ability to work effectively and flexibly across a range of products and services in a busy and commercial environment.

Key Accountabilities

  • Act as lead lawyer for Barclays Wealth's Individual Savings Account (ISA) proposition. Liaise as needed with lawyers in other divisions advising on differing ISA propositions
  • Act as a trusted advisor and deliver sound legal advice in relation to the laws and regulations governing Barclays Wealth's use of investment research
  • Act as a key contact point for bankers and other personnel in Wealth & Investments
  • Support other lawyers in connection with the key client-facing terms and conditions entered into with clients of Barclays Wealth, including drafting of variations, and working closely with Compliance colleagues on the conduct risk issues associated with those variations
  • Support other lawyers advising on the documentation applicable to the distribution of third party mutual funds
  • Support work in relation to digital initiatives, such as online client terms and conditions
  • Advise on the Barclays Investment Account proposition, including its terms and conditions
  • Maintain a log of guidance on commonly-arising queries on your product set, for sharing with colleagues in Legal and the Business, with the aim of dealing more efficiently with repetitive queries
  • Assist in reviewing and updating contractual and other legal arrangements
  • Support Wealth & Investments Legal's participation in various business risk and operating committees
  • Identify and advise on emerging legal and regulatory risks, including on the implementation of new legislation and regulatory requirements, such as MiFID II, bank ring-fencing and Brexit, working with senior colleagues
  • Manage and control external legal resources in terms of cost and performance, including negotiation and settlement of external lawyers' fees

Person Specification

  • Qualified lawyer (ideally two or more years' PQE) with experience in retail investment services and/or wealth management. An adjacent area would be considered if the candidate is enthusiastic to develop in this area
  • Experience of delivering new or altered products and services as a result of regulatory and/or business change
  • Regulatory knowledge of the UK and EU laws on investment products and services, such as collective investment schemes and broader wealth management services
  • Contributes to technical developments in their coverage area
  • Has a good understanding of key legal and non-legal risks, and partners with others to manage them
  • Takes ownership for identifying, analysing and communicating risk
  • Escalates risk and control issues appropriately
  • Understands the internal and external business context, and Barclays' products and services
  • Provides tailored, commercial advice and recommendations
  • Understands external spend drivers and identifies cost-saving opportunities
  • Able to understand and articulate the strategy and goals for the team
  • Assists in the design and implementation of projects and other longer-term objectives
  • Able to manage projects and matters
  • Works effectively within time, resource and budget constraints
  • Able to communicate effectively and manage relationships with both colleagues and internal and external clients
  • Builds strong relationships, especially with other colleagues in the Legal function

Risk and Control Objective
