AQUILA a consortium between NATs and Thales are recruiting a Commercial Manager who will be responsible for supporting and developing the aims and objectives of the commercial function as stated above. The Commercial Manager will support a major Air Traffic Management (ATM) delivery programme to the UK MOD. AQUILA will deliver a capability upgrade that will provide the MOD with ATM Services for a period of 22 years. The Commercial Manager will oversee the contractual affairs of designated areas within the business unit throughout the entire Project Life Cycle, encompassing the bidding for, negotiation of and subsequent management of contracts of higher value and/or complexity.
Key tasks and responsibilities
To lead and/or carry out the following activities in respect of all designated bids and contracts without the need for regular supervision by the BU Head of Commercial (whilst keeping him or her appropriately informed):
Serve as a focal point of contact for customers regarding contractual matters by establishing good customer relationship and communications.
Proactive participation in the business winning Core Bid Team, including:
o Generate the Commercial Response in accordance with the agreed strategy and customer requirement
o Assisting Bid Managers to generate Proposal Documentation (statement of work, Risk Register and Executive Summary) matched to Customer requirements
o Undertaking a commercial review of the full suite of proposal documents.
o Submission of proposal
o Ensuring that proposals to customers are priced, developed and approved in accordance with company procedures
Prepare and/or review (as appropriate) the response to customers proposed contractual agreements (NDAs, Teaming Agreements, TAAs, Contracts etc).
Support the development and implementation of the negotiation strategy, including payment profiles and associated terms to meet the cash flow requirements of the business.
Prepare and negotiate new contracts and amendments to existing contracts and arrange for their approval.
Ensure a robust Contract Baseline is established and maintained, including contractual changes.
Provide guidance on compliance to terms and conditions, identifying the flow down of such terms and conditions and supporting the assessment of supply chain gap analysis'.
Assist the Sub Contract Management function by supporting subcontract negotiations as required.
Identification of potential liabilities, risks, issues and disputes, arising with customers, suppliers, partners and third parties, and produce innovative mitigation plans.
Interpret, when required, for the benefit of the broader project team, the contracted requirement (including but not limited to terms and conditions and scope of work).
Adhere to functional procedures, CHORUS and in particular the WinBid process.
Maintain contractual records, documentation of key correspondence, status and issue reports etc.
The management, in conjunction with Finance of cash receipts to the business.
Populate and maintain new and existing tools such as Contratheque, HERMES and Oracle (CORDIS/MAX) to ensure timely and accurate commercial information to all stakeholders.
Where applicable, manage other members of the commercial department.
Undertake AAD/PDD activities with assigned team in accordance with company procedures.
To set the standard for expectations of management behaviour in line with the DAE UK Management Charter.

Desirable Skills and Experience Required
Detailed working knowledge of defence contracting (MOD/export) and/or civil/commercial aerospace contracting.
Proven track record on successful commercial proposal preparation and negotiation.
Drafting and negotiation of complex contracts and agreements.
Comprehensive understanding of commercial risks and issues.
Team player with the ability to make and influence decisions.
Strong interpersonal and verbal and written communication skills.
Ability to identify and implement change within the commercial function and to support/lead the change process to improve effectiveness of the business and/or commercial function.
Experience of staff management.
Computer literate.
Qualifications
Relevant degree (desirable)
Relevant professional qualification eg CIPS (desirable)
Personality/Behaviours
Ability to interface well and influence effectively at senior management internally and externally with customers, partners and suppliers.
